Duo Convicted for Defiling Four Minors

Two convicts have been handed a life sentence after they were separately found guilty of defiling four minors in Changamwe and Jomvu sub-Counties in Mombasa County.

In the first case, Resident Magistrate Hon. Green Odera sentenced Darius Mboga alias Kevo, 32, on three counts of defilement contrary to Sections 8(3) and 8(4) of the Sexual Offences Act after he was found guilty of defiling three boys.

He was also convicted on three counts of committing an indecent act contrary to Section 11(1) of the Sexual Offences Act.

The court heard that between 2021 and the 11th of May 2022, Mbogam who operates a barber shop at Msikiti-Noor area, sodomised the three minors aged 9, 12 and 16.

Principal Prosecution Counsel Purity Musembi presented six witnesses with the court ruling that their testimonies were consistent and corroborative.

The court heard that the accused pretended to be a good Samaritan and took in the minors when their mother died, but instead repeatedly defiled them.

The case came to light on 11th of May 2022 after a teacher noticed one of the boys was walking strangely and upon questioning, the minor disclosed the accused had been sexually abusing him.

The matter was reported to police, and the boys were taken to Coast Provincial General Hospital where medical reports confirmed sexual abuse.

Hon. Green Odera ruled that the prosecution, had proved its case beyond reasonable doubt as medical evidence corroborated the minors’ testimony as well as that of other witnesses.

In the second case, a 24-year-old boda boda rider was also sentenced to life imprisonment for defiling an 8-year-old girl.

Hassan Bakari Kombo was convicted on the main count of defilement contrary to Section 8(1) as read with Section 8(2) of the Sexual Offences Act.

The court also considered the alternative count of committing an indecent act with a child contrary to Section 11(1) of the same Act.

Hon. Odera stated that the prosecution which presented five witnesses, had proved its case beyond reasonable doubt.

The court heard that the accused defiled the grade 3 minor on 7th December 2024 at about 2:00am at Mnazi Mmoja, Mikindani Location within Jomvu sub-county after the guardian left her under his care and proceeded to work.

The girl informed her mother of the ordeal, who in turn informed the police.

Medical evidence corroborated witness statements, dismissing the convict’s defence that he was framed.

Both men were granted 14 days to appeal against their conviction and sentence.
