Waititu Freed After High Court Revises Bail in 588M Case

Former Ferdinand Waititu has been released from custody after the High Court of Kenya revised his bail terms as he awaits the outcome of his appeal in the Sh588 million Kiambu roads graft case.

The development emerged on Thursday when the matter came up for mention before the court’s Anti-Corruption and Economic Crimes Division.

Waititu’s lawyer, Jeremy Njenga, told the court that the former governor had already secured his freedom following the review of the bond conditions.

“I am holding brief for the appellant who is now a free man thanks to your orders,” Njenga told the court, referring to earlier directions that enabled Waititu’s release from Kamiti Maximum Security Prison.

Waititu had been jailed after he was convicted in February 2025 over the irregular award of a Sh588 million road construction tender in Kiambu County, in one of the high-profile corruption cases involving a senior county official.

Justice Wilfrida Okwany earlier allowed an application to review the bond terms pending the hearing and determination of the appeal.

In her ruling, the judge reduced the bail requirement to Sh20 million cash, enabling Waititu to secure his release as he challenges both the conviction and the sentence imposed by the trial court.

Previously, the court had required him to post a Sh53 million bond with a bank guarantee, conditions that had kept him in custody since his conviction.

During Thursday’s mention, the court also addressed appeals filed by Waititu’s co-appellants in the same case, including former Kiambu County Chief Officer for Transport Luka Mwangi Wahinya and businessman Charles Chege Mbuthia, a director of Testimony Enterprises Limited.

The court directed that the appeals and applications filed by the three appellants be mentioned together on April 14, 2026, noting that the cases arise from the same trial proceedings and have since been consolidated for joint hearing.
